1. Eligibility

Only individuals competent under the Indian Contract Act, 1872 may access or use our services. By using the website, you confirm that you are at least 18 years of age and legally capable of entering into binding contracts.

2. Orders & Acceptance

  • An order placed by you constitutes an offer to purchase.

  • Acceptance of your order will occur only when the products are dispatched, at which point a binding contract arises.

  • Vanupvan reserves the absolute right to refuse or cancel any order without assigning reasons, especially in cases of errors in product listing, pricing, or suspected misuse.

3. Pricing & Payment

  • All prices displayed are in INR and inclusive of applicable taxes, unless mentioned otherwise.

  • We reserve the right to correct any pricing errors, even after an order has been placed.

  • Payment must be made in full before dispatch through our approved payment gateways.

4. Delivery & Risk

  • We will endeavour to deliver products within the indicated timelines. However, delivery dates are indicative and delays may occur due to circumstances beyond our control.

  • Risk of loss and damage passes to you once the product is handed over to the courier. Title transfers upon dispatch from our facility.

5. Returns, Cancellations & Refunds

  • Plants: Due to the perishable and fragile nature of plants, orders once dispatched are generally non-returnable. However, if a plant is delivered in a damaged or unhealthy condition, you must notify us within 24 hours of delivery with photographic evidence. Vanupvan may, at its discretion, provide a replacement or store credit.

  • Non-plant items (pots, accessories, etc.): Unused and unopened items may be returned within 7 days of receipt, subject to inspection.

  • Order cancellations: Cancellations are accepted only if made within 2 hours of order placement and before dispatch.

  • Refunds, if approved, will be processed via the original mode of payment within a reasonable time.

6. Warranties & Disclaimers

  • We make every effort to provide healthy plants and quality products. However, natural variations, growth differences, and minor discrepancies in colour, size, or condition are inherent and not defects.

  • Except as expressly stated, Vanupvan disclaims all warranties, express or implied, including but not limited to merchantability and fitness for a particular purpose.

7. Limitation of Liability

To the fullest extent permitted by law, Vanupvan’s liability for any claim, whether in contract, tort, or otherwise, shall not exceed the total amount paid by you for the product in dispute. We shall not be liable for indirect, consequential, or incidental damages including, but not limited to, loss of profit, business interruption, or emotional distress.

8. Force Majeure

Vanupvan shall not be liable for failure or delay in performance due to circumstances beyond reasonable control, including but not limited to acts of God, pandemics, governmental restrictions, strikes, transport delays, or natural calamities.

9. User Obligations

You agree not to:

  • Misuse the website or place fraudulent orders.

  • Violate intellectual property rights of Vanupvan.

  • Engage in conduct that may damage the website, interfere with services, or harm other users.

10. Intellectual Property

All content on the Vanupvan website — including but not limited to logos, product images, text, and design — is the intellectual property of Vanupvan. You may not copy, reproduce, distribute, or exploit such content without prior written consent.

11. Dispute Resolution & Governing Law

  • These Terms shall be governed by the laws of India.

  • In case of any dispute, the parties shall first attempt amicable resolution. Failing that, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, to be conducted in Jaipur, in English language, by a sole arbitrator mutually appointed.

  • The decision of the arbitrator shall be final and binding.

  • Subject to arbitration, the courts at Jaipur, Rajasthan shall have exclusive jurisdiction.

12. Indemnity

You agree to indemnify, defend and hold harmless Vanupvan, its officers, employees, and affiliates from any claims, damages, or losses arising from your breach of these Terms or misuse of the website.

13. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force.
